National Treatment for Foreign Investment in China: A Changing Landscape

Abstract :

The national treatment standard has become an important feature in both domestic and international legislation, but China was historically reluctant to grant such treatment due to its former planned economy. However, as China seeks to integrate further into the world, economically and otherwise, a recent policy shift can be identified with regard to national treatment. This article examines this shift, first, by discussing China’s changing policy toward foreign direct investment. The article then analyses the establishment and development of national treatment in China in both its domestic legislation and international investment treaties. Recent measures to eliminate ‘superior national treatment’ in China’s domestic legislation are also examined, as well as China’s changing approach in international investment law. Finally, the article concludes with a discussion on the future agenda of China’s national treatment policy with particular reference to the ongoing bilateral investment treaty negotiations with the European Union and the United States.

Abstract :

Recent State practice strongly suggests that the international economic law architecture for the 21st century largely will be shaped in the Pacific Rim region. Negotiations of two "mega-regional" free trade agreements - the Trans-Pacific Partnership (TPP) and the Regional Comprehensive Economic Partnership (RCEP) - continue to advance. Japan, Korea, and China recently concluded a trilateral investment agreement. The world's two largest economies - China and the United States - held their 17th round of bilateral investment treaty negotiations in December. Japan has announced a "Revitalization Strategy," identifying a number of economic priorities, including the negotiation of new investment agreements. Asia-Pacific Economic Cooperation (APEC) members recently agreed to launch a feasibility study, proposed by China, to consider a potential Free Trade Area of the Asia-Pacific agreement (FTAAP).

Market Access Provisions in the Potential EU Model BIT: Towards a “Global BIT 2.0”?

Abstract :

One of the defining features of the new generation of European investment treaties is the inclusion of market access provisions. It remains to be seen, however, whether and to what extent this might become a standard practice of the eu. This article attempts to answer this question first by reviewing the development of market access policy in the eu and then by analyzing treaty practice on market access both at the eu level and at Member State level. Subsequently, it discusses the more specific issues that may be involved in market access provisions in the potential eu Model bit. It concludes that the world is witnessing a new generation of investment treaties (“Global bit 2.0”) with the eu and other major economic players accepting concrete market access or investment liberalisation commitments, which shall to a considerable degree help pave the way towards a multilateral investment treaty (mit).

Abstract :

自从17岁考上中山大学以来,我就再没有离开过大学,不是在念书,就是在教书,有时也承担一些管理工作。我在英国的大学里前后待了16年。这期间,我在剑桥大学这所老牌大学做过访问学者,读过博士学位;也在牛津布鲁克斯大学这所新派大学任过教职,从讲师开始,一直做到教授;还在伦敦、利物浦等"红砖大学"兼职从事过教学研究工作。现在虽然已经全职回国,但在剑桥仍然保留着一份资深研究员的兼差,因此对英国的大学可以说有一定的经历和了解。在我看来,英国的大学精神,就是大学作为一个由学者、学生组成的学术共同体的独立和自由的精神。

指出国民待遇是衡量一国一地投资环境的核心评价标准之一,也是民众广泛关注的一个重要话题;认为随着中国市场经济体制的基本确立和总体经济实力的极大增强,中国从总体上已经具备了给予外资国民待遇的基本条件,但这并不等于在所有行业、所有省区均可门户洞开,同步全面实施国民待遇,而应该因地制宜、因业制宜,各有先后和侧重;建设“全国内陆型开放战略高地”,陕西需要根据全国政策指向和本省实际情况,设计制定适合本省需要的政策、法规和措施,落实国民待遇,推动外资发展;进而探讨了陕西利用外资应有的政策定位,并提出了落实外资国民待遇的六点建议.

The Potential EU-China BIT: Issues and Implications

Abstract :

This article attempts to discuss the issues and implications of the potential bilateral investment treaty between the EU and China, the negotiation of which was recently launched. After briefly exploring the current legal framework governing mutual investment between China and EU, including the developments after the Treaty of Lisbon, it focuses on the general and specific issues that may be involved in the potential BIT including the regulation of State Owned Enterprises, national security review, pre-establishment national treatment, transparency and exhaustion of local remedy. The paper concludes that the EU-China BIT will help enhance the EU-China bilateral investment relations, improve the legal framework of China and contribute to the development of global international investment regime. Legal Education in China: The New “Outstanding Legal Personnel Education Scheme” and Its Implications

Abstract :

After more than 60 years of development, the People's Republic of China has established the world's largest size of legal education, with 624 law schools and 450,000 thousands of undergraduate students currently enrolled. As Wenhua Shan explains, whilst the quality of education has also been improved, it generally falls short of meeting the domestic and international challenges that China is facing in legal education and practice. The most important measure recently adopted by the Chinese Government to enhance the quality of legal education, the “Outstanding Legal Personnel Education Scheme”, is poised to bring significant changes to the structure, contents and methods of Chinese legal education; and it will boost deeper cooperation between law schools and the practice sectors. Further measures are nevertheless required to achieve the desired results of the scheme and to place Chinese legal education in an internationally competitive position.
